Today marks an important date for Polish IP matters, since now we have specialized intellectual property courts!
On July 1st an extensive update to Polish civil procedure has entered into force. Most importantly it creates 5 regional courts (or really – divisions) and 2 appellate courts that will deal exclusively with intellectual property cases. In our opinion it will lead to shorter proceedings and improved judgement quality, as the judges will be able to work only on a particular, smaller, field of law.
What is also new and unique is that it will be possible to counter-sue for invalidation of the IP right that lies at the base of the original claim before the same court. Until yesterday it was only possible in case of EU trademarks and Registered Community Designs, and now it’ll be possible for all other rights during the same court proceedings. Nevertheless, it is still possible to invalidate before the Polish Patent Office.
As of today the XXII Division of the Regional Court in Warsaw has been abolished, and a new XXII Division of Intellectual Property has been established.
